JIT Solution – Incident Cost Tracker is a digital incident, inspection, cost tracking, and reporting solution designed to help organisations record incidents, identify operational losses, calculate incident-related costs, manage corrective actions, and generate management reports.
The system may include:
Incident reporting forms.
Initial inspection forms.
Cost calculation forms.
AI-assisted incident classification.
Missing information prompts.
Cost estimation support.
Root cause suggestions.
Corrective action tracking.
Dashboards and reports.
Finance review workflows.
User, site, department, and role management.
3. User Responsibilities
Users agree to:
Provide accurate and complete information.
Use the system only for lawful business purposes.
Keep login details secure and confidential.
Not share unauthorised access with others.
Not upload false, misleading, offensive, unlawful, or harmful content.
Not attempt to damage, copy, reverse engineer, bypass security, or misuse the platform.
Notify JIT Solution immediately if unauthorised access or a security issue is suspected.
4. Client Responsibilities
Client organisations are responsible for:
Ensuring authorised users are properly trained.
Managing user access, roles, and permissions.
Reviewing and approving incident records, costs, reports, and corrective actions.
Ensuring information entered into the system is accurate and appropriate.
Complying with workplace health and safety, privacy, employment, record keeping, and other legal obligations.
Obtaining any required consent before entering personal, sensitive, health, employee, resident, client, or contractor information into the system.
5. AI-Assisted Features
The platform may use AI-assisted features to support classification, cost estimation, root cause suggestions, missing information prompts, anomaly detection, and corrective action recommendations.
AI outputs are provided for assistance only and must not be treated as professional, legal, medical, financial, workplace safety, or compliance advice.
Final decisions remain the responsibility of the client organisation and authorised users.
6. Incident Cost Calculations
The platform may calculate the Total Cost of Loss using information entered by users, including quantity lost, unit cost, labour hours, labour rate, downtime hours, downtime cost, repair cost, replacement cost, medical cost, admin cost, contractor cost, and other relevant cost inputs.
JIT Solution does not guarantee that cost calculations are complete, exact, or suitable for accounting, insurance, taxation, legal, or regulatory purposes unless separately agreed in writing.
Clients should review and verify all cost outputs before relying on them for business decisions.
7. Subscription, Fees, and Payment
Fees may include setup fees, subscription fees, usage-based incident charges, additional user fees, support fees, customisation fees, or other agreed charges.
All pricing will be in Australian dollars unless otherwise stated.
GST may apply where required.
Payment terms will be stated in the relevant proposal, invoice, service agreement, or order form.
Failure to pay fees may result in restricted access, suspension, or termination of services.
8. Refunds and Cancellations
Refunds, cancellations, and service changes will be managed in accordance with the applicable proposal, service agreement, and Australian Consumer Law.
Under Australian Consumer Law, businesses must meet consumer guarantees when selling goods or services, and contract terms cannot remove rights that exist under the law.
9. Intellectual Property
All intellectual property in the JIT Solution platform, forms, templates, dashboards, workflows, reports, design, software, branding, documentation, and related materials remains owned by JIT Solution or its licensors.
Clients may use the platform and materials only for their internal business purposes during the active service period.
Clients must not copy, resell, reproduce, modify, distribute, or commercially exploit the platform or materials without written permission.
10. Client Data
Client data remains the property of the client organisation.
JIT Solution may access, process, store, and use client data only for purposes connected with providing, maintaining, improving, securing, supporting, and administering the service.
JIT Solution will take reasonable steps to protect client data, but clients remain responsible for the accuracy, legality, and appropriateness of data entered into the system.
11. Privacy
Personal information will be handled in accordance with our Privacy Policy and applicable privacy laws.
The Office of the Australian Information Commissioner explains that Australian Privacy Principle 1 requires open and transparent management of personal information, including having a clearly expressed and up-to-date privacy policy where required.
12. System Availability
JIT Solution aims to provide a reliable service, but we do not guarantee that the platform will be uninterrupted, error-free, or available at all times.
Access may be affected by maintenance, updates, hosting issues, internet outages, third-party provider issues, cyber incidents, or events beyond our control.
13. Limitation of Liability
To the maximum extent permitted by law, JIT Solution is not liable for indirect, incidental, special, consequential, or business losses, including loss of profit, revenue, data, reputation, contracts, productivity, or business opportunity.
Nothing in these Terms excludes rights, guarantees, or remedies that cannot be excluded under Australian Consumer Law or other applicable laws.
14. No Professional Advice
The platform is a business support and reporting tool. It does not replace professional advice from qualified legal, financial, accounting, insurance, safety, medical, clinical, or compliance professionals.
Clients should obtain professional advice where required.
15. Security
Users must not:
Attempt unauthorised access.
Bypass authentication or security controls.
Upload malware or harmful files.
Interfere with system operation.
Use the platform for unlawful, fraudulent, or harmful activity.
JIT Solution may suspend or terminate access where misuse, security risk, or breach of these Terms is suspected.
16. Termination
JIT Solution may suspend or terminate access if:
Fees are unpaid.
A user or client breaches these Terms.
The service is misused.
Security risks are identified.
Required client cooperation is not provided.
Legal or regulatory requirements require suspension or termination.
Clients may cancel services in accordance with the relevant proposal, subscription agreement, or service agreement.
17. Changes to Terms
JIT Solution may update these Terms & Conditions from time to time. Updated terms will be published on our website with the revised effective date.
Continued use of the service after changes are published means the updated Terms are accepted.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the courts of Victoria and any courts entitled to hear appeals from those courts.
